The United States (through <em data-start=\"573\" data-end=\"580\">Alice<\/em> and <em data-start=\"585\" data-end=\"591\">Mayo<\/em>), Europe (via the \u201ctechnical character\u201d test), and China (with its four-category AI guidelines) are converging on a common requirement: <strong data-start=\"728\" data-end=\"799\">patents are not for ideas, but for demonstrable technical solutions<\/strong>.<\/p>\n<p data-start=\"804\" data-end=\"1027\">This means that simply claiming an algorithm, dataset, or business method will not suffice. What matters is <em data-start=\"912\" data-end=\"917\">how<\/em> the invention works: the novel technical mechanism that improves speed, accuracy, security, or efficiency.<\/p>\n<h2 data-start=\"1034\" data-end=\"1062\">South Africa\u2019s position<\/h2>\n<p data-start=\"1063\" data-end=\"1182\">South Africa\u2019s <a href=\"https:\/\/www.gov.za\/documents\/patents-act-9-apr-2015-0827\">Patents Act 57 of 1978<\/a> closely follows the European model.
