{"id":3621,"date":"2025-12-19T04:57:27","date_gmt":"2025-12-19T04:57:27","guid":{"rendered":"https:\/\/itlawco.com\/?p=3621"},"modified":"2025-12-19T04:59:12","modified_gmt":"2025-12-19T04:59:12","slug":"when-security-becomes-surveillance-cctv-privacy","status":"publish","type":"post","link":"https:\/\/itlawco.com\/fr\/when-security-becomes-surveillance-cctv-privacy\/","title":{"rendered":"When security becomes surveillance: CCTV and privacy"},"content":{"rendered":"\n\t\t<div id=\"fws_6aa154df5a2f5\"  data-column-margin=\"default\" data-midnight=\"dark\"  class=\"wpb_row vc_row-fluid vc_row\"  style=\"padding-top: 0px; padding-bottom: 0px; \"><div class=\"row-bg-wrap\" data-bg-animation=\"none\" data-bg-animation-delay=\"\" data-bg-overlay=\"false\"><div class=\"inner-wrap row-bg-layer\" ><div class=\"row-bg viewport-desktop\"  style=\"\"><\/div><\/div><\/div><div class=\"row_col_wrap_12 col span_12 dark left\">\n\t<div  class=\"vc_col-sm-12 wpb_column column_container vc_column_container col no-extra-padding inherit_tablet inherit_phone \"  data-padding-pos=\"all\" data-has-bg-color=\"false\" data-bg-color=\"\" data-bg-opacity=\"1\" data-animation=\"\" data-delay=\"0\" >\n\t\t<div class=\"vc_column-inner\" >\n\t\t\t<div class=\"wpb_wrapper\">\n\t\t\t\t\n<div class=\"wpb_text_column wpb_content_element \" >\n\t<p>Insight into <a href=\"https:\/\/www.saflii.org\/za\/cases\/ZAWCHC\/2025\/430.html\">Phillips and Another v Bradbury (Appeal) (A200\/2024) [2025] ZAWCHC 430<\/a> (17 September 2025)<\/p>\n<hr \/>\n<\/div>\n\n\n\n\n<div class=\"wpb_text_column wpb_content_element \" >\n\t<p data-start=\"626\" data-end=\"825\">In September 2025, the <a href=\"https:\/\/www.judiciary.org.za\/index.php\/judiciary\/directives\/high-court-of-south-africa\/western-cape-division-of-the-high-court\">Western Cape High Court<\/a> delivered a judgment that brings much-needed clarity to the constitutional limits of private surveillance and domestic security systems in South Africa.<\/p>\n<p data-start=\"827\" data-end=\"1173\">Although the dispute arose between neighbours, the judgment has far-reaching implications for residential estates, employers, technology providers, bodies corporate and organisations deploying CCTV or other monitoring technologies.<\/p>\n<p data-start=\"827\" data-end=\"1173\">At its core, the Court affirmed a principle that is becoming increasingly important in a surveillance-heavy world: <strong data-start=\"1175\" data-end=\"1378\">Systematic, technology-enabled monitoring of another person\u2019s private space can constitute a serious infringement of the constitutional rights to privacy and dignity \u2014 even when framed as \u201csecurity\u201d.<\/strong><\/p>\n<\/div>\n\n\n\n\n<div class=\"wpb_text_column wpb_content_element \" >\n\t<h2 data-start=\"1380\" data-end=\"1403\">The dispute in brief<\/h2>\n<p data-start=\"1405\" data-end=\"1684\">The case concerned CCTV cameras installed on a residential property that maintained a continuous line of sight into a neighbouring home. The cameras captured areas that are ordinarily regarded as private, including a swimming pool, entertainment areas, a courtyard and a bedroom.<\/p>\n<p data-start=\"1686\" data-end=\"2068\">Despite repeated requests to reposition the cameras so as to eliminate the intrusive line of sight, the homeowners refused, citing heightened crime risk, load shedding and the vulnerability of properties in the area. A court at first instance ordered the cameras to be repositioned to remove the invasion of privacy. That order was taken on appeal to a Full Bench of the High Court.<\/p>\n<p data-start=\"2070\" data-end=\"2111\">The appeal was dismissed in its entirety.<\/p>\n<\/div>\n\n\n\n\n<div class=\"wpb_text_column wpb_content_element \" >\n\t<h2 data-start=\"2113\" data-end=\"2160\">Privacy is not defeated by security rhetoric<\/h2>\n<p data-start=\"2162\" data-end=\"2505\">The High Court confirmed that the right to privacy protected by <a href=\"https:\/\/www.gov.za\/documents\/constitution\/chapter-2-bill-rights#14\">section 14 of the Constitution<\/a> extends beyond protection against physical intrusion. Drawing on established Constitutional Court jurisprudence, the Court held that privacy includes protection against unwarranted observation and surveillance, particularly where monitoring is:<\/p>\n<ul>\n<li data-start=\"2509\" data-end=\"2535\">continuous or persistent<\/li>\n<li data-start=\"2538\" data-end=\"2563\">technologically enabled<\/li>\n<li data-start=\"2566\" data-end=\"2636\">directed at spaces forming part of a person\u2019s intimate domestic life<\/li>\n<\/ul>\n<p data-start=\"2638\" data-end=\"3081\">Importantly, the Court rejected the argument that security concerns automatically justify intrusive monitoring. Even where crime prevention is a legitimate objective, the Constitution requires proportionality. Where less restrictive measures are reasonably available\u2014such as alarm systems, electric fencing, motion sensors or alternative camera placement\u2014persistent visual monitoring of a neighbour\u2019s private space cannot be justified.<\/p>\n<blockquote>\n<p data-start=\"3083\" data-end=\"3150\">Security, the Court made clear, is not a constitutional trump card.<\/p>\n<\/blockquote>\n<\/div>\n\n\n\n\n<div class=\"wpb_text_column wpb_content_element \" >\n\t<h2 data-start=\"3152\" data-end=\"3198\">Surveillance as nuisance and dignitary harm<\/h2>\n<p data-start=\"3200\" data-end=\"3347\">One of the most significant aspects of the judgment lies in its integration of common-law nuisance principles with constitutional privacy doctrine.<\/p>\n<p data-start=\"3349\" data-end=\"3677\">Historically, nuisance law focused on physical interference with the use and enjoyment of property. The Court recognised that modern surveillance technologies alter the nature of interference itself. Continuous monitoring can cause psychological and dignitary harm, fundamentally changing how individuals experience their homes.<\/p>\n<blockquote>\n<p data-start=\"3679\" data-end=\"3979\">The judgment affirms that living under constant observation is itself a form of injury. Surveillance is not rendered harmless simply because it is passive, automated or remote. Where it is persistent, unavoidable and focused on private spaces, it crosses the threshold into unlawful interference.<\/p>\n<\/blockquote>\n<p data-start=\"3981\" data-end=\"4119\">This represents an important evolution in South African law, aligning nuisance doctrine with contemporary realities of digital monitoring.<\/p>\n<\/div>\n\n\n\n\n<div class=\"wpb_text_column wpb_content_element \" >\n\t<h2 data-start=\"4121\" data-end=\"4162\">Expectation of privacy remains central<\/h2>\n<p data-start=\"4164\" data-end=\"4359\">The Court reaffirmed the established \u201cdual expectation\u201d test for privacy: a person must subjectively expect privacy, and that expectation must be one society recognises as objectively reasonable.<\/p>\n<p data-start=\"4361\" data-end=\"4699\">Private areas such as swimming pools, courtyards, entertainment spaces and bedrooms clearly satisfy this standard. The fact that an area may be visible from certain vantage points does not strip it of constitutional protection.
