After years of negotiations, the EU AI Act was eventually finalised and published on 12 July 2024. It\u2019ll enter into force 20 days later, on 1 August 2024. That\u2019s all good and well, but does the EU AI Act apply to South African businesses?<\/span><\/p>\n

This article outlines what the AI Act means for businesses using AI, focusing on whether the Act applies to South African businesses. We\u2019ll also suggest practical steps to comply with the Act\u2019s obligations. Vitally, the Act introduces significant fines for those who fail to meet its obligations.<\/span><\/p>\n

This article focuses only on AI users, known as \u201cdeployers\u201d under the AI Act<\/strong>. Article 3 of the Act defines \u201cdeployers\u201d as natural or legal persons using an AI system under its authority, except where it is used in a personal non-professional activity.<\/em> In other words, this article doesn\u2019t focus on the obligations of AI system providers, importers, or distributors.<\/span><\/p>\n
